These Terms of Use (“Terms”) govern your access to and use of the Fathom research preview (the “Preview”), provided by Fathom Seismic (“Fathom,” “we,” “us,” or “our”). By accessing or using the Preview, you agree to these Terms. If you do not agree, do not access or use the Preview.

1. Research preview; limited access

The Preview is a pre-release research prototype made available to a limited group of invited users for evaluation and feedback. It is provided on an invitation-only, access-controlled basis. Access may be modified, suspended, or withdrawn at any time, and features may change or be removed without notice. The Preview is not a commercial product and is not intended for production use.

2. No public disclosure

Access to the Preview is provided in confidence to a limited audience. Making the Preview available to you does not constitute, and shall not be construed as, a public disclosure, publication, or public availability of the Preview or any of its features, designs, methods, or underlying technology by Fathom. Nothing in your access to or use of the Preview places any part of the Preview in the public domain.

3. Confidentiality and non-publication

The Preview — including its user interface, features, functionality, performance characteristics, design, and any related information that is not publicly available from Fathom (collectively, the “Preview Materials”) — is confidential to Fathom. You agree that, without Fathom’s prior written consent, you will not:

You may share private feedback with Fathom. If you wish to publish, present, or otherwise make public anything relating to the Preview, contact Fathom in advance to request written consent.

4. Your data stays on your device

The Preview is designed to process your seismic data locally in your browser. Your seismic data is not uploaded to or stored on Fathom’s servers. You are responsible for your data and for maintaining your own backups. See our Privacy & Cookies notice for details about the limited information we do process (such as sign-in identity).

Subject to these Terms, Fathom grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Preview solely for your internal evaluation and to provide feedback to Fathom. You will not:

If you provide Fathom with feedback, suggestions, or ideas about the Preview (“Feedback”), you grant Fathom a perpetual, irrevocable, worldwide, royalty-free license to use and incorporate the Feedback for any purpose, without obligation or compensation to you.

7. Intellectual property

Fathom and its licensors own all right, title, and interest in and to the Preview and the Preview Materials, including all intellectual property rights. Except for the limited license expressly granted in these Terms, no rights are granted to you, whether by implication, estoppel, or otherwise.

8. No warranty

The Preview is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. Fathom does not warrant that the Preview will be uninterrupted, error-free, or secure, or that any results obtained from it are accurate or reliable. You use the Preview at your own risk.

9. Limitation of liability

To the maximum extent permitted by law, Fathom will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of or inability to use the Preview. Fathom’s total aggregate liability arising out of or relating to the Preview will not exceed one hundred U.S. dollars (US$100).

10. Termination

Fathom may suspend or terminate your access to the Preview at any time, for any reason, without notice. Sections 2, 3, 6, 7, 8, 9, and 11 survive termination. Upon termination, you must stop using the Preview and destroy any Preview Materials in your possession.

11. General

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. You and Fathom submit to the exclusive jurisdiction of the state and federal courts located in Delaware for any dispute arising out of or relating to these Terms or the Preview, and consent to personal jurisdiction and venue in those courts. If any provision is found unenforceable, the remaining provisions remain in effect. These Terms are the entire agreement between you and Fathom regarding the Preview and supersede any prior agreements relating to it. Fathom may update these Terms from time to time; the “Last updated” date reflects the latest version, and your continued use after changes take effect constitutes acceptance.
